Eviction notice rules in Idaho

Nonpayment notice

3 days to pay or quit (I.C. §6-303(2)). The notice must state the exact amount owed and warn a residential tenant of the post-judgment 72-hour belongings-removal period.

Lease-violation notice

3-day cure or quit for noncompliance (I.C. §6-303(3)) — notice must describe the problem and give the tenant the option to fix it or vacate.

Unconditional quit (no second chance)

3-day quit, no cure, for assigning or subletting contrary to the lease, or committing waste (I.C. §6-303(4)); drug manufacture/delivery/use on the premises is also unlawful detainer (I.C. §6-303(5)).

No-cause / end-of-tenancy notice

30 days' written notice to end a month-to-month tenancy (I.C. §55-208).

How the notice must be served

Personal delivery first; if the tenant is absent from residence and business, substituted service (leave with a person of suitable age + mail a copy); posting + mailing only as a last resort (I.C. §6-304). Service mistakes are one of the most common reasons landlords lose UD cases.

Your right to fix it (cure)

Nonpayment (3 days to pay); curable noncompliance (3 days to cure). No cure for unauthorized subletting, waste, or drug activity.

How days are counted

The first day is excluded; the last day is excluded only if it is a holiday — weekends otherwise count (I.C. §73-109).

After the notice expires

Landlord must file a forcible entry and unlawful detainer action (I.C. §§6-301-6-324). The tenant does NOT have to leave when the notice expires — only a court judgment can remove the tenant, enforced by the sheriff via a writ of restitution.

The one thing to remember: in Idaho, as in every state, a notice is not an eviction. Your landlord must file a case, serve you properly, and win before a judge. Only a court order can remove you.
